Although marriage begins with love and hope, sadly, it is becoming more and more common for marriages to end in divorce. Over 50 percent of first-time marriages, 65 percent of second marriages, and almost 75 percent of third marriages end in divorce. It is painful and confusing enough without having to go through it alone and unprepared. You need an experienced and knowledgeable firm to protect you and what’s most important – your family.
Anyone can claim to fight for you, but you need to know how to fight if you want to maximize your chances of success and protecting your rights. Generally, three main topics will be handled during your divorce:
- Dividing assets and money earned during the marriage
- Establishing conservatorship, visitation and child support
- Depending on the facts, spousal maintenance
Grounds for Divorce in San Antonio, Texas
There are seven legal grounds for divorce in the state of Texas. One ground (insupportability) results in a “no-fault” divorce, meaning neither party is accused of any wrongdoing or is held responsible for the end of the marriage. This is simply when you and your spouse have decided to end your relationship and move on with your lives separately. The other six grounds require a spouse to be assigned fault.
- Insupportability (unresolvable differences or conflicts; divorce can be granted as “no-fault” on this ground)
- Adultery
- Cruelty
- Conviction of felony (your spouse has been convicted of a felony, imprisoned for over one year, and has not been pardoned. However, a divorce may not be granted if your testimony was used in court to convict your spouse.)
- Abandonment (of at least one year with intent to abandon)
- Confinement to a psychiatric hospital for at least three years
- Living apart (for at least three years)
If your spouse disagrees with any information detailed in your divorce papers, he or she can “contest” it, and you will have court appearances to resolve any issues. If all issues and information in the documents are agreed upon by both spouses, this is considered an “uncontested divorce.”
To file for divorce in Texas, at least one spouse has to have been a resident of the state for a minimum of six continuous months and a resident of the county in which the divorce is filed for at least 90 days. It can be granted by a judge 60 days after the initial petition is filed. However, if the spouses are not in agreement, it may take several months to a year before the divorce can be finalized.
